These Terms & Conditions apply when you visit our website, place an order or purchase products from us. By using our website or placing an order with Dàya Creations, you agree to the terms outlined below.
We recommend reading these Terms & Conditions before placing an order, particularly when purchasing personalised products.
Our Products
Dàya Creations specialises in personalised chocolates created for weddings, engagements, bridal showers, baby showers, birthdays, corporate events and other special occasions.
As many of our products are individually personalised, the final appearance of each order may vary slightly from images displayed on our website or social media.
We make every effort to display product colours and designs as accurately as possible. However, colours may appear differently depending on your device, screen settings, printing process and materials used.
Small variations are a normal part of creating personalised products and do not necessarily mean that an item is faulty.
Personalised Orders
When placing a personalised order, you are responsible for providing accurate information.
This includes names, dates, wording, spelling, colours, quantities and any other details required to create your design.
Please carefully review the information you provide before submitting your order.
If you realise you have provided incorrect information, contact us as soon as possible. We will do our best to make the requested change, but changes cannot be guaranteed once designing, printing or production has begun.
Design Proofs & Approval
Where applicable, Dàya Creations may provide a digital design proof for you to review before your order is produced.
It is your responsibility to carefully check the entire design, including spelling, names, dates, wording, layout and other personalised details.
Once you approve your design, you are confirming that you are happy for us to proceed with production.
If an error appears in the final product exactly as it appeared in an approved design, Dàya Creations may not be responsible for replacing the order at no cost.
If we make an error that was not present in your approved design, please contact us so we can assess the issue and provide an appropriate solution.
Orders & Payment
All prices displayed on our website are in Australian dollars (AUD) unless otherwise stated.
Payment must be made using one of the payment methods available at checkout or another payment method agreed to by Dàya Creations.
An order is not considered confirmed until the required payment has been successfully received.
We reserve the right to decline or cancel an order where reasonably necessary, including where there has been an obvious pricing error, product availability issue, suspected fraudulent transaction or an order we are unable to reasonably fulfil.
If we cancel an order after payment has been received and you are entitled to a refund, the relevant amount will be returned to you.
Product Availability
Our products, packaging, chocolate varieties and materials are subject to availability.
Occasionally, an item or material may become unavailable after an order has been placed. If this happens and it materially affects your order, we will contact you to discuss an appropriate alternative or other available options.
Food & Allergen Information
Our chocolates typically contain the following ingredients:
Sugar, whole milk powder, cocoa butter, cocoa liquor (or chocolate liquor), lactose, soy lecithin (emulsifier), and vanilla extract.
Allergen Information: Contains milk and soy. Products may also contain traces of other allergens depending on the chocolate used and the manufacturing environment.
Ingredients and allergen information may vary between products or if our suppliers change. Customers should always check the ingredient and allergen information provided on the product packaging before consumption.
If you or your guests have any allergies, intolerances or specific dietary requirements, please contact us before placing an order so we can provide further information.
While we take care when handling our products, Dàya Creations cannot guarantee an allergen-free environment unless expressly stated otherwise.
Chocolate Storage
Chocolate is sensitive to temperature and should be stored appropriately.
We recommend keeping your chocolates in a cool, dry place away from direct sunlight, heat and moisture.
Customers are responsible for appropriately storing chocolates after they have been delivered or collected.

Event Dates
When ordering personalised chocolates for an event, you may be asked to provide your event date.
Customers are responsible for ordering with sufficient time for designing, production and delivery.
We recommend placing orders well in advance, particularly during busy periods.
Shipping and delivery estimates are not guarantees, and circumstances outside our reasonable control may occasionally cause delays.
Shipping & Delivery
Shipping costs and available delivery methods will be displayed at checkout or communicated to you before your order is confirmed.
Customers are responsible for providing complete and accurate delivery information.
Once an order has been dispatched, delivery is handled by the relevant postal or courier provider.

Cancellations, Returns & Refunds
Because personalised products are made specifically for each customer, cancellations, changes, returns and refunds may be limited once work on an order has begun.
This does not exclude any rights or remedies you may have under Australian Consumer Law.

Photographs & Customer Content
If you provide photographs, logos, artwork or other content for us to incorporate into a personalised design, you confirm that you have the necessary permission or rights to provide and use that material.
You must not ask us to reproduce material in a way that infringes another person's intellectual property, privacy or other legal rights.
We reserve the right to decline content that we reasonably believe may infringe another person's rights or is otherwise inappropriate or unlawful.
Our Designs & Website Content
Unless otherwise stated, the designs, photographs, graphics, branding, logos, website content and other original materials created by Dàya Creations remain the property of Dàya Creations.
Our content must not be copied, reproduced, sold, distributed or used for commercial purposes without our permission, except where permitted by law.
Purchasing a personalised product does not transfer ownership of the underlying Dàya Creations design or artwork to the customer.
Product Photography & Social Media
We may photograph products we create for the purpose of displaying our work on our website, social media or other Dàya Creations marketing materials.
If you would prefer that your personalised order is not photographed or shared, please contact us before your event or before your order is completed.
We will respect reasonable requests regarding the privacy of personalised details.
Website Information
We make reasonable efforts to ensure that information displayed on our website is accurate and up to date.
However, occasional errors may occur, including errors relating to pricing, descriptions, availability or website content.
Where an obvious error occurs, we reserve the right to correct it and, where necessary, contact affected customers.
Limitation of Liability
To the extent permitted by law, Dàya Creations will not be responsible for losses caused by circumstances outside our reasonable control.
Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

Australian Consumer Law
Nothing in these Terms & Conditions is intended to exclude, restrict or modify any rights or remedies you may have under the Australian Consumer Law.
Where our products fail to meet a consumer guarantee under Australian Consumer Law, you may be entitled to a repair, replacement, refund or other remedy as required by law.
You can still have your rule that change-of-mind refunds aren't generally available for personalised chocolates. The ACL statement just makes it clear that this doesn't override customers' legal rights if there's actually something wrong with the product.
